Abstract

The article examines the problem of imbalance in modern anti-corruption activities, in which effective anti-corruption measures generally dominate the protection of citizens’ rights. The purpose of the study is to provide a theoretical justification, develop a concept and specific measures to ensure a balance between anti- corruption and anti-corruption protection based on the principle of proportionality. The results of the study revealed negative trends, excesses of «excessive law enforcement», such as underestimation of standards of evidence in cases of bribery and prioritization of minor offenses. A balanced model is proposed that integrates anti- corruption ideas and anti- corruption protection mechanisms, including prevention, legal education, including criminal law audit, as well as emergency and offensive protection. The author concludes that the transition to the paradigm of balance will increase the legitimacy and effectiveness of all anti-corruption activities. The implementation of the proposed algorithms will help to harmonize the interests of the individual, society and the state
