- Abstract
The successful recovery of stolen assets and compensation for damage caused by criminal acts requires a solid legislative framework with a wide range of tools in this area. Currently, the stages of the international search and seizure of criminal assets in criminal proceedings, as well as after the end of the investigation, have significant problems in regulation at the legislative level and are partially compensated only by the rules established by legal acts of departmental and interdepartmental levels. In this regard, the legislative consolidation of effective mechanisms for the search, seizure and seizure of corrupt proceeds after the end of the preliminary investigation, including after sending a criminal case to court, will eliminate the lack of an institutional framework and make up for the lack of the necessary capacity of competent authorities to search, recover and confiscate criminal assets. As part of the solution to these issues, this study uses the results of the work of the Investigative Committee of the Russian Federation on the return of assets from abroad, compensation for damage and measures to identify property in respect of which confiscation measures can be taken. In addition, international experience in the legal regulation of the search and recovery of assets obtained by criminal means has been taken into account
